Don't Plead Guilty to Reckless Driving Without Calling Us First

You should be aware of the consequences of pleading guilty to a reckless driving charge. First of all, there is no "pre pay" allowed for reckless driving — you must address the charges in court. However, hiring an attorney ordinarily does keep you from having to appear in court. If you do not have a lawyer, you will have to make an appearance or risk being tried in your absence.

Other consequences of a reckless driving charge include:

  • Reckless driving is a criminal misdemeanor. It is a six-point violation in Virginia, and you could face a driver's license suspension of anywhere from 30 days to six months.
  • If you are an out-of-state driver, a reckless driving conviction will be reported to your home state and points will be added to your license. Your license can also be suspended in your home state for a reckless driving conviction even if you are not from Virginia.
  • In Virginia, driving 20 mph or more over the posted speed limit and driving over 80 mph are not just speeding tickets, they are reckless driving. For serious reckless driving offenses jail time can be imposed.
  • If you are a commercial driver, a reckless driving conviction could lose you your CDL.

If you have a good driving record and were polite to the police officer, we may be able to get your ticket reduced out of the reckless driving category. This means a lower fine, a smaller increase in your insurance rates, and possibly keeping your license. For commercial drivers, it means keeping your job.
